These Terms of Service ("Terms" or "Agreement") govern your access to and use of Off The Grid Chat ("the Service"), operated by Off The Grid Chat ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into this Agreement, and that you are not prohibited from using the Service under any applicable law. The Service is not available to any users previously removed by us.
If you believe another user may be underage, please report them directly in the app by tapping their username and selecting "Report underage user", or contact us at [email protected]. We will promptly review and remove confirmed underage accounts.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to:
We are not liable for any losses caused by unauthorized use of your account. You may delete your account at any time from Settings โ Account Actions โ Delete Account.
You agree not to engage in any of the following prohibited activities:
We may, without prior notice, change the Service, stop providing features, or impose usage limits. We may permanently or temporarily suspend or terminate your access for any violation of these Terms or for any reason at our sole discretion.
The Service allows you to post messages and other content ("User Content"). We claim no ownership rights over your User Content. You agree not to post User Content that:
We have the right, but not the obligation, to remove any User Content at our sole discretion. You are solely responsible for your User Content and the consequences of posting it. You understand you may be exposed to User Content posted by others that is inaccurate, offensive, or otherwise objectionable, and we are not liable for such content.
By posting User Content on the Service, you grant us a non-exclusive, royalty-free, worldwide license to store, display, transmit, and distribute that content solely as necessary to operate and provide the Service to you and other users. This license terminates when your content is deleted in accordance with our retention schedule. We will not use your content for advertising or commercial purposes beyond what is necessary to operate the Service.
By posting User Content, you represent and warrant that: (i) you own or have all rights necessary to post such content and to grant the license above; (ii) your content does not infringe any third-party intellectual property, privacy, or publicity rights; (iii) your content complies with these Terms and all applicable laws; and (iv) we may exercise the rights granted above without liability for any guild fees, residuals, or royalties.
Off The Grid Chat employs a two-tier moderation system to maintain community standards:
Moderators may take the following actions for violations of these Terms or Community Guidelines:
All moderation actions are logged with the acting moderator, target user, reason, and timestamp. Users who are muted or banned will see a Purgatory notification explaining the action.
Appeals: Muted or banned users may submit an appeal through the in-app appeal system. Appeals are reviewed by OTGC-Mods and the platform owner. All appeal decisions are final and logged.
We reserve the right to modify, suspend, or terminate any account at our sole discretion for violations of these Terms, without prior notice and without liability.
Users who create or manage chat rooms ("Room Owners") accept additional responsibilities:

The Service includes a virtual token system ("Tokens") and other virtual items. You acknowledge that:
Certain features, including the Divinity subscription, require payment. If you use paid features, you agree to the pricing and payment terms displayed in the Service, which we may update at any time. All payment information must be accurate and current. You are responsible for all applicable taxes on your purchases.
The Service is an anonymous chat platform. Nothing on the Service constitutes professional medical, legal, financial, psychological, or other expert advice, regardless of who provides it. Any information shared by other users is for informational and conversational purposes only and should not be relied upon as professional advice. You should seek independent guidance from a licensed professional for any such matters. We are not liable for any action taken or not taken based on content available through the Service.
Except for your User Content, the Service and all materials therein โ including software, images, text, graphics, logos, avatars, and other content โ are the exclusive property of Off The Grid Chat and its licensors. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, or create derivative works from any Service content except as expressly permitted by these Terms. Use of any Service content for any purpose not expressly permitted is strictly prohibited.
If you submit ideas or suggestions about the Service, you agree that such disclosures are gratuitous and without restriction, and we are free to use them without any compensation or obligation to you.
The Service integrates third-party providers including Supabase (database), Cloudflare (hosting and compute), Resend (email), Anthropic (Claude AI features), and Leonardo.ai (avatar artwork generation). The Service may also contain links to third-party websites or services. We do not endorse or assume responsibility for any third-party sites, information, products, or services. Your use of third-party services is at your own risk and subject to their respective terms and privacy policies. We expressly disclaim any liability arising from your use of any third-party service or content.
We respect intellectual property rights and respond to valid notices of copyright infringement under the Digital Millennium Copyright Act of 1998 (DMCA). We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any conduct we determine to be harmful to the Service or its users. Upon termination for any reason, you remain bound by these Terms.
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We are not responsible for user-generated content and do not endorse any views expressed by users.
No advice or information obtained from us or through the service creates any warranty not expressly stated in these terms. Federal law and some states do not allow exclusion of certain implied warranties, so the above may not apply to you in full.
To the maximum extent permitted by applicable law, Off The Grid Chat and its operators, agents, licensors, and affiliates shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service โ even if we have been advised of the possibility of such damages.
In no event shall our total cumulative liability to you for all claims arising from or relating to these terms or the service exceed the greater of: (i) the total amount you paid us in the 12 months preceding the claim, or (ii) $100 USD. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory.
Some states do not allow exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full.
You agree to defend, indemnify, and hold harmless Off The Grid Chat and its operators, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your use of or access to the Service; (ii) your User Content; (iii) your violation of any provision of these Terms; (iv) your violation of any third-party right, including intellectual property or privacy rights; or (v) your violation of any applicable law or regulation.
Before initiating any formal legal or arbitration proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days of receiving your written notice describing the nature and basis of the claim and the relief sought. If we cannot resolve the dispute informally within 60 days, either party may proceed to arbitration as set forth in Section 18.
After completing the informal dispute resolution process in Section 17, any claim, dispute, or controversy arising out of or relating to these Terms or the Service โ excluding claims for injunctive or other equitable relief โ shall be resolved exclusively by binding arbitration administered by JAMS under its then-current applicable rules. The arbitration shall be conducted in Texas unless both parties agree otherwise. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
The parties acknowledge that this Agreement involves interstate commerce and is governed by the Federal Arbitration Act (9 U.S.C. ยงยง 1โ16). Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or data security breaches.
All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class action, collective action, private attorney general action, or other representative proceeding. The arbitrator may not consolidate more than one person's claims unless both parties expressly agree. By entering into this agreement, you and Off The Grid Chat each waive the right to a trial by jury and the right to participate in any class action, collective action, or other representative proceeding of any kind.
If the class action waiver in this Section 18B is found to be unenforceable by a court of competent jurisdiction, the entirety of Section 18 (Arbitration) shall be null and void, and the dispute shall be resolved in a court of competent jurisdiction in Texas.
These Terms are governed by the internal substantive laws of the State of Texas, without regard to its conflict of law principles. For any claims not subject to arbitration (including claims for injunctive relief), you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Texas.
These Terms, and any rights and licenses granted under them, may not be transferred or assigned by you without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section shall be null and void.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. Exception: if the class action/jury trial waiver in Section 18B is found unenforceable, the entirety of Section 18 shall be void.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy and any additional agreements you enter into with us in connection with the Service, constitute the entire agreement between you and Off The Grid Chat concerning the Service and supersede all prior or contemporaneous agreements and understandings.
